Chicago Fair Workweek Provision Delayed

On Wednesday (May 20), the Chicago City Council passed an amendment (O2019-3928) to the Chicago Fair Workweek ordinance (O2019-3928), which delays the private right of action provision (i.e., an employee’s right to sue) for an employer’s noncompliance with the scheduling requirements until Jan. 1, 2021. This amendment recognized that, due to the COVID-19 pandemic, many employers cannot accurately predict scheduling.

On May 12, Office of Labor Standards (OLS) published the Fair Workweek rules, including Fair Workweek COVID-19 Rules. The rules can be found on the Department of Law Rules Portal.
