Workers’ Comp Emergency Rule Repealed

The Illinois Workers’ Compensation Commission today repealed an emergency rule that would have made workers’ compensation benefits available to essential employees who contracted COVID-19 without having to prove they contracted the coronavirus in the workplace. A Sangamon County judge had granted a temporary restraining order against the rule last week after a lawsuit was filed by the Illinois Retail Merchants Association and the Illinois Manufacturers’ Association, contending that such a rule must come from the General Assembly.
